Data Protection and GTC 

1. Preamble

The teamworx media management GmbH operates a medical media library under www.vielgesundheit.at around the topics of top-level medicine and health. The central concern is clarification and prevention in the medical and health sector. The responsibility for vielgesundheit.at lies with the teamworx media management GmbH, which is briefly known as "vielgesundheit.at".

vielgesundheit.at does not assume any liability for the technical content of the films/contents.

The following gender designations are gender neutral.

2. General - Scope of Application

The login on www.vielgesundheit.at serves exclusively to provide specialist information to natural persons with unlimited legal capacity and legal entities who are members of the medical healing professions or are pursuing a training for one of the above-mentioned professions, as well as employees of the pharmaceutical industry or service companies associated with it, pharmacists, specialist journalists as well as students of medicine and pharmacy ("specialist area users").

The use of the login area and the associated applications are subject to the General Terms and Conditions described below. By using the specialist login, the user agrees to these General Terms and Conditions.

3. Granting of Rights of Use

The use of the vielgesundheit.at specialist area requires registration. vielgesundheit.at reserves the right to verify user data on a random basis and, in individual cases, to obtain further information from the applicant regarding their professional affiliation (e.g. for doctors through the notification of the medical license number at the Medical Association). If a verification reveals that the user does not have the necessary professional affiliation, the specialist login access will be immediately terminated.

The "Double Opt in Procedure" is applicable for registration. After the applicant has registered, a confirmation link is sent to the e-mail address they entered, which must be confirmed. Afterwards, the applicant generally receives the confirmation of their registration. However, the specialist area user has no claim to approve or to make use of the vielgesundheit.at services.

vielgesundheit.at reserves the right to refuse admission without stating reasons, especially due to

a) false information given at the time of registration,

b) unauthorized disclosure of the password or

c) violation of the conditions or misuse of the vielgesundheit.at services, allowing refusal and termination without notice at any time.

Admission, activation, and the use of the vielgesundheit.at specialist login area is free of charge.

 

Logout

Every specialist area user is entitled to withdraw their registration at any time in writing (by e-mail to service@vielgesundheit.at). In this case, all data stored by vielgesundheit.at about the user will be deleted – at the latest - one month after receipt of the withdrawal of the registration.

If a users’ membership in one of the occupation groups listed under point 2 ends, they must inform vielgesundheit.at immediately by e-mail. Consequently, the access to the specialist area is hereby terminated.

Each specialist area user may only register once. Any obsolete registrations must be reported to vielgesundheit.at. vielgesundheit.at will delete such registrations.

4. Use of Access Data, Account and E-Mails

The user is solely responsible for the accuracy of the data stored. An update of the user data is possible at any time in the created online profile. Correspondence between the user and vielgesundheit.at is sent to the e-mail address provided by the user.

The users’ access data (username and password) must not be passed on to and shall be protected from misuse by third parties. The user bears sole responsibility for actions taken under their user access.

Loss of login data must be reported immediately to vielgesundheit.at to block access to the specialist area. This also applies if the user assumes misuse of their access data.

To offer the user free of charge access to vielgesundheit.at via the specialist area login, all information concerning the specialist login user data and password, will be communicated by e-mail. By applying for the vielgesundheit.at password, the user hereby declares their consent. The cancellation of account e-mails is only possible by terminating the vielgesundheit.at access.

vielgesundheit.at intends to further inform its specialist area users about new services offered by the medical media library www.vielgesundheit.at, provided that this has been approved by the user during registration by means of confirmation in a check box.

The specialist area user can change, restrict, or cancel the sending of information e-mails at any time by changing their notification settings via the specialist login access. E-mails from vielgesundheit.at may contain personalized and/or personal information, as well as information that may only be accessible to specific occupational groups. Therefore, these should not be forwarded to third parties.

5. Liability

The user indemnifies vielgesundheit.at from all claims asserted by third parties against vielgesundheit.at based on the way the user uses the specialist login area. vielgesundheit.at is not liable for the transfer of specialist login access to third parties.

Furthermore, vielgesundheit.at assumes no liability for the fact that the specialist login user, when using vielgesundheit.at services, does not violate relevant legal provisions, such as the law on unfair competition, the medical practitioner’s law or other relevant provisions.

Transmission paths on the internet are not secured against unauthorized access by third parties. This means that participants with sufficient technical abilities on the internet have the possibility to access, read and edit third-party data. The user bears the associated risks. vielgesundheit.at assumes no liability for the consequences of any third-party access.

The website content of the specialist login users or third parties, in particular the content of websites to which vielgesundheit.at provides a link, is the sole responsibility of the relevant specialist login user or website operator.

6. Choice of Law, Place of Jurisdiction

The execution of the services mentioned in these Terms and Conditions are subject to Austrian law. vielgesundheit.at contracts exclusively to these Terms and Conditions in the current version. The application of the UN Convention on Contracts for the International Sale of Goods from the 11th of April 1980 is excluded. The place of performance is Vienna, the place of jurisdiction is the Vienna Commercial Court. vielgesundheit.at is represented in a legally friendly manner by attorney Katharina Braun (www.rechtsanwaeltin-braun.at).

7. Use of Data, Data Protection

Personal data is only collected to the extent necessary for technical reasons and for the booking of further education points (see point 9). Under no circumstances will the collected data be sold. The transfer of data to third parties is exclusively to the Österreichische Akademie der Ärzte GmbH for the purpose of booking the points on the accounts of the participating doctors.

The data processing is based on the legal provisions of § 96 para. 3 TKG and Art 6 para. 1 lit a (consent) and/or lit b (necessary for the performance of the contract) of the DSGVO. The user is entitled to the rights of information, correction, deletion, restriction, data transferability, revocation, and objection. If the user believes that the processing of their data violates data protection law or their data protection rights have been violated in any way, the user can complain to the supervisory authority. In Austria, this is the data protection authority.

To continuously optimize user-friendliness, vielgesundheit.at uses tools on their website for anonymous tracking of user behaviour.

vielgesundheit.at also uses cookies to measure the effectiveness of advertisements. Particularly, information about the time of the users’ visit and the advertising clicked on is collected and stored. This information is not passed on to third parties but is only used for campaign management and campaign control. In addition, user profiles are created which are used for vielgesundheit.at own market research purposes - based on the interests identified.

Google Analytics

The concern of vielgesundheit.at in terms of the DSGVO is the improvement of the offer and web presence. The data processing is based on the legal provisions of § 96 para. 3 TKG and Art 6 para. 1 lit a (consent) and/or lit b (necessary for the performance of the contract) of the DSGVO.

This website uses Google Analytics, a web analysis service of Google Inc. ("Google"). Google Analytics also uses cookies. The information generated by the Google Analytics cookie about the users use of this website is usually transferred to a Google server in the USA and stored there. Google Analytics is certified under the US-EU data protection agreement "Privacy Shield".

However, by activating IP anonymization on this website, the users IP address will be shortened by Google within member states of the European Union or in other states which are party to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transferred to a Google server in the USA and shortened there. On behalf of the operator of this website, Google will use this information for the purpose of evaluating the users use of the website, compiling reports on website activity and providing other services relating to website activity and internet usage. The IP address transmitted by the users’ browser within the scope of Google Analytics is not combined with other data from Google.

The user may refuse the use of cookies by selecting the appropriate settings on the browser; however, it is to be noted, that this may not allow the user to use the full functionality of this website. The user can also prevent the collection of data generated by the cookie and related to the users’ usage of the website (including the users IP address) and the processing of this data by Google by downloading and installing the browser plugin available on the following link: http://tools.google.com/dlpage/gaoptout?hl=de

This website uses the analytics functions User ID to track interaction data. This User ID is additionally anonymized, encrypted and is not linked to any other data.

Facebook Pixel

Within our Internet presence we use the "visitor action pixel" of

Facebook Inc.

This allows the behaviour of users to be tracked after they have been redirected to the provider's website by clicking on a Facebook Ad. This process is used to evaluate the effectiveness of Facebook Ads for statistical and market research purposes and can help optimize future advertising efforts.

The collected data is anonymous for vielgesundheit.at, meaning vielgesundheit.at cannot draw any conclusions about the identity of the users. However, the data is stored and processed by Facebook so that a connection to the respective user profile is possible and Facebook can use the data for its own advertising purposes, in accordance with the Facebook Data Usage Guidelines (https://www.facebook.com/about/privacy/). The user can enable Facebook and its partners to place advertisements on and outside of Facebook. A cookie may also be stored on the users’ computer for these purposes.

8. Copyright, License and Trademark Law

The design of this website, as well as its contents, i.e. the source code, the texts, images, graphics, layouts, sounds, animations, videos and databases etc. are protected by copyright and, unless third parties have rights to the contents, all rights of use and exploitation in favour of vielgesundheit.at are reserved. Licensing is only possible in a non-electronic written form.

Nothing contained herein shall be construed as conferring by implication, estoppel or otherwise, any license or title to any copyright, patent, or other proprietary right of vielgesundheit.at or any third party.

9. Miscellaneous

vielgesundheit.at is entitled to store and process the users’ personal data underlying these General Terms and Conditions (specialist login area). In the online update procedure, vielgesundheit.at is entitled to transmit the users’ IT configuration data to vielgesundheit.at. vielgesundheit.at points out that the users’ personal data will be stored to the extent necessary for the specialist use of the vielgesundheit.at online services. As part of the online update procedure, technical data will be collected automatically, transmitted to vielgesundheit.at and stored there, to the extent necessary for the proper and contractually compliant transmission of updates. No data will be passed on outside the use of the specialist login area of the vielgesundheit.at online services.

If any of the provisions of this contract are not legally effective in whole or in part or lose their legal effectiveness, the validity of the rest of the contract shall not be affected. In this case, the parties undertake to agree an effective provision in place of the invalid provision which, as far as legally possible, comes closest to the economic purpose pursued by the invalid provision, taking into account the interests of the parties expressed in this contract. The same shall apply if the contract contains a gap not provided for by the parties.

If vielgesundheit.at amends these General Terms and Conditions, these shall become part of the contract if vielgesundheit.at sends them to the user for perusal and the user does not object to their contractual inclusion within six weeks and vielgesundheit.at separately notifies the user of the consequences of his silence when announcing the General Terms and Conditions.

vielgesundheit.at is entitled to provide services through third parties, which however, does not create a contractual relationship between the user and these third parties.
